You (“the Consignor”, “You” or “Your”) have read Style and Give LLC. ( “Our”, or “Us”) Consignment Contract. I understand that by sending my items to Style and Give I am agreeing to the commission and terms of this Consignment Contract. I agree to all of the Terms and Conditions outlined below.
A. Process - Upon receipt of your item(s) Style and Give LLC. will be responsible for the promotion and customer service to sell, including: authentication, resale market price evaluation, detailed description, photography, online posting, email promotion, answering customer inquiries, secure packing, shipping and insurance. We will take all necessary steps to sell your item(s) quickly and at the best price possible. We reserve the right to accept or reject an item for any reason
B. Authentication - Style and Give LLC. will authenticate all items using years of experience and third party companies. We reserve the right to return at your expense any items we deem counterfeit. If you would rather we destroy the counterfeit merchandise, we will.
C. Commission Donation - Style and Give will donate as directed by the Consignor’s approved charity on the 10th of each month if the donation exceeds $20.00 or 120 days after the last item of the Consignor’s has sold.
D. Pricing - Style and Give LLC. will research extensively and price items at the current fair market value. All list prices are determined at Our sole discretion unless We have previously agreed otherwise with You in writing.
E. Consignment Period and Donation Policy - All items are consigned for a minimum of 365 days. Unsold items will be returned at Consignor’s expense or will become the sole property of Style and Give LLC to donate or use at our discretion.
F. Payouts - Payouts are issued on the 10th of each month for the prior month's sales to Consignor’s selected payout method mutually acceptable to You and Us.. Style and Give LLC. percentage includes all fees associated with the sale of the item. For example, payments processed on August 10th would cover the sales period from July 1 through July 31.
G. Condition of Items - Any item dry cleaning or repairs needed will be deducted from the consignor’s account.
H. Cancellation of Consignment - Considering the time and energy invested into each listing, there will be a $50 cancellation fee plus shipping costs to return your items.
I. Limitation of Liability - Style and Give LLC. will take diligent care of the consigned pieces as to the best of its ability and while we take every precaution to protect your items against loss and/or damages while they are in our care, Style and Give LLC. is not responsible in the event of theft, fire, flood or act of nature while your items are in our possession. This includes any damage caused by a customer, fire, flood, earthquakes, stains, tears, missing pieces, damage caused during shipping, or any other damage with no exclusions of man made or natural damages to consigned items.
J. Charity Selection 501(c)(3) - Style and Give LLC can only donate to legally registered tax-exempt organizations as described in Section 501(c)(3) of the Federal Internal Revenue Code or a tax-exempt school or library.
Our Terms of Service (TOS) are located at: https://styleandgive.com/pages/terms-condation, are incorporated by reference and made a part of this Agreement to which You are agreeing, and such TOS additionally apply to any of Your and Our activities under this Agreement.
Legal Right to Consigned Items and Authenticity. Consignors guarantee that all items consigned to Style and Give LLC. for sale are lawfully and entirely owned by me or I am acting on behalf of a person(s) who have given me the authority to sell such items on their behalf. I guarantee to indemnify Style and Give LLC. for any damages, penalties, fines, fees or judgments for any issue arising due to the rights of the lawful owner of the merchandise being placed on consignment. Only original, authentic designer items are accepted by Style and Give LLC. for consignment. By submitting items for consignment, the consignor states that the items are authentic designer items and not counterfeit.
By mailing Your items to Style and Give LLC., I certify that I (“the consignor”) fully understand and agree to all of the Terms and Conditions in this Consignor Contract. I also state that all information on this is true and correct.
